After seeing this update:
I think it warrants discussion.
I really disagree with this rule. It has the same issues as the situation with team options not counting that we fixed for the upcoming off-season. If a team has a player with Bird rights and they are also under the cap then they basically get to double up on their salary cap space.
As far as I can tell these are the upcoming free agents who will have Bird rights:
Jeff Teague - Atlanta Hawks
Dirk Nowitzki - Dallas Mavericks
James Harden - Denver Nuggets
Stephen Curry - Golden State Warriors
Blake Griffin - Los Angeles Clippers
Kobe Bryant - Los Angeles Lakers
Thabo Sefolosha - Oklahoma City Thunder
Luckily the only serious issues come with the Lakers and the Warriors. I'll try to illustrate my issue with these teams.
After this season the Lakers will have more than $25 million in salary cap space and the following players under contract:
Nikola Vucevic
Zach Randolph
Harrison Barnes
Goran Dragic
Shane Larkin
That is a pretty good lineup already and he'll have tons of cap space to try and some very get-able guys like Luol Deng, Marcin Gortat, DeMar DeRozan or whoever else Magic wants to target. He'll also be able to throw big money at some of the top free agents like Blake Griffin and who knows, he might actually be able to sign one of them. Then after all that he'll get to add Kobe Bryant to his roster at no charge whatsoever since his salary won't count.
For the Warriors the issue is that Chris Mullin will get $13 million dollars he shouldn't have to sign free agents. Which will likely go toward trying to re-sign Iguodala who doesn't have Bird rights. Realistically all his money should be going toward re-signing Stephen Curry, it makes no sense that he'll also get a large amount of cap space to sign another really good player.
Honestly we should be doing the opposite of this rule and have cap holds against a team's salary cap for players with Bird rights like they do in the NBA. At the very least we should have free agency structured so the Bird rights free agents sign first in order to eliminate the possibility that teams will be able to sign players for free.
Once a player is re-signed using Bird Rights, their new contract does not count against the team's salary cap until after the Off Season Free Agency period.
